The proposed development shall consist of: 6 1-Bedroom 1 storey houses (2 person); 2 2-Bedroom Ground Floor Apartments (3 person); 2 2-Bedroom First Floor Apartments (3 person). The works include: Landscaping works to boundaries and all necessary associated ancillary works on the site and to adjacent areas including community room. The housing provision comprises of one storey terraced units and two storey terraced end units grouped around a central courtyard. The proposed Scheme has undergone Appropriate Assessment Screening under the Habitats Directive (92/43/EEC) and a preliminary examination for Environmental Impact Assessment. The Planning Authority has concluded that there will be no real likelihood of significant effects on the environment arising from the proposed development and therefore an Environmental Impact Assessment is not required. Landscaping Features including a Boules Court, four insect bars (timber kickabout posts) two pollinator flower beds, bulb planting and tree planting, including a fruit orchard. these features were carried out with the knowledge, involvement and agreement of South Dublin County Council in partnership with the local Resident's Association and local residents. In particular SDCC required that written agreement be secured from houses 25-34 Pearse Brothers Park before works proceeded. These letters were collected and submitted to SDCC in advance of installation. The works formed part of a co-mapped, co-designed community amenity enhancement project led by Ballyboden Tidy Towns and SDCC's Public Realm section a letter of permission/support was requested by SDCC of the local residents association as there was a historical agreement that no development works would take place on the subject site. The planning status of their original installation is the subject of a section 5 which is not yet determined. This application concerns solely the removal of the amenities and whether such action constitutes development requiring planning permission.

The removal of an existing pedestrian public footpath within Pearce Brothers Park. and grass verge resulting in reduction of pedestrian infrastructure and pedestrian safety and mobility. the removal, reallocation, or reduction of 9 existing public car parking spaces in connection with the development approved under Part 8 (REF SD218/0008) resulting in the net loss of car parking provision in an estate the provision of those 9 car spaces was as a result of Deputation meeting in 2007 and a series of public consultations by SDCC Roads dept and residents and local residents association. SDCC had previously recognised the shortfall historically of parking spaces. it was also noted at TRAC and discussed regularly in 2006 and 2007 by councillors and a solution was agreed to removing a strip of zoned open space and install publicly designated on - street car parking - the subject of this current Section 5 Application.
